TERMS & CONDITIONS 

Welcome to the Terms and Conditions page of Spicers of Hythe Ltd.  

By purchasing our hampers or gifts from www.spicersofhythe.com or by phone, you agree to these terms and conditions. Please check this section regularly for updates. 

COPYRIGHT 

All photographs, images, and graphics on this website are the property of Spicers of Hythe Ltd. Any unauthorised use or copying of these elements, including our products or descriptions, is a copyright infringement. If you wish to sell our hampers via your website, please obtain our permission. 

PLACING AN ORDER 

Spicers of Hythe Ltd will accept orders: 

Any amendments to an accepted order must be made via email or telephone no later than 13:00 GMT on the working day before your chosen delivery date. If the order is increased from the agreed quantities, extra lead-time may be required. 

ORDER CANCELLATION 

Due to the components of our hampers, orders can only be cancelled prior to despatch (with the request being made no later than 13:00 GMT the working day before your chosen delivery date). 

To cancel an order, please contact our Customer Service team via email (customerservice@spicersofhythe.com) or by telephone 01303 235600. 

We will be unable to refund an order if the following applies: 

  • Incorrect delivery information, or date, provided at the point of placing the order. 
  • Carrier unable to deliver due to unavailability of recipient and the hamper is returned. 
  • The parcel has been accepted by a recipient at the address provided (but the delivery details are incorrect). 
  • The parcel has been refused at the point of delivery (due to the incorrect delivery details) unless the refusal is due to the goods being damaged. 

The returned parcel can be re-despatched or redirected to another address however a re-delivery charge would apply. Please contact our Customer Service team regarding any issues and do not attempt to return a hamper to us on your own volition as we do not accept customer-driven returns and would therefore not issue a refund, or any return costs, under any circumstances. 

FRESH FOOD HAMPERS 

Our Fresh Food hampers guarantee a minimum shelf life of 7 days from despatch for fresh produce, such as cheese and salmon. Please ensure that you stipulate if you are purchasing items in advance for a future date. Fresh Food hampers are only available for delivery to UK mainland addresses, and we cannot deliver them on a Monday. If you want your hamper delivered on a specific day, please specify this in your order. These hampers have an orange 'perishable' sticker and must be opened and refrigerated within 48 hours of despatch to ensure that the contents remain safe to consume. It is the recipient's responsibility to store the product appropriately to ensure freshness. 

AMBIENT FOOD HAMPERS 

Our Ambient Food hampers guarantee a 14-day shelf life for goods like cakes, biscuits, and chocolate. We cannot be held responsible for incorrect storage of these products once they have been delivered to you. If there is a problem with an item or product, please follow the damaged order process and contact us within 14 days of your delivery date. 

GIFT MESSAGES 

We offer the option of adding a personalized gift message of up to 240 characters (including spaces and punctuation) for each delivery address. The message is printed on 170gsm A5 paper that folds to A6 and is included in a docket on the outside of the box. For privacy, both the personalized message and delivery label are hidden. 

If you have specific requirements or wish to send in your own message cards, please contact us for further information and advice. However, please note that this option is only available for large corporate orders. 

To ensure the accuracy and efficiency of your order, please provide us with the correct information at the time of ordering, including accurate address details (including postcodes), recipient(s) telephone number, any gift message(s), special delivery instructions, and details of which hampers are to be sent to each address. 

PAYMENTS 

All orders must be paid for in full before the goods are dispatched. We accept the following payment methods: 

  • Credit/Debit cards: Visa, Mastercard, and American Express. All card payments are validated and authorised before completing your order. Please note that if your payment is not authorised, we cannot be held liable for non-delivery of your goods. 
  • BACs: Please refer to your invoice for our bank details and the reference you must use. 

CREDIT/DEBIT CARD SECURITY 

To authorize card payments, all details are encrypted and passed between us and our Payment Service Provider (PSP) using 256-bit SSL certificates. 

OUR PAYMENT SERVICE PROVIDER 

We use Stripe Payments as our Payment Service Provider (PSP). They are a certified PCI Service Provider Level 1, which is the most stringent level of certification available in the payments industry. Stripe Payments uses the best-in-class security tools and practices to maintain a high level of security for both the company and the customer, protecting against fraud. 

For those receiving a corporate quotation invoice, please note that the bank details will correspond to Stripe Payment. 

 

DAMAGED OR DEFECTIVE HAMPERS 

At Spicers of Hythe, we take great care in packaging our hampers to prevent any damage. However, in rare instances, a parcel may become damaged during transit. If this occurs, the courier may identify the damage before delivery and notify us so we can contact you as soon as possible. 

If you receive a damaged parcel, please refuse delivery, and contact us immediately. We will resend your order quickly and report the damage. If you or the recipient receive a damaged or defective hamper and are unable to refuse delivery, we guarantee to replace or refund the hamper in full if you contact us within 48 hours of delivery. 

If we request to see the hamper, we will arrange the collection at no cost to you, but the recipient is responsible for making the hamper available for collection between Monday to Friday 09:00 to 17:00 GMT (except Bank Holidays). If requested, please take a photograph of the damaged or defective hamper(s), and forward a copy to customerservice@spicersofhythe.com. 

Please note that if you contact us outside of the 48-hour window, we are not liable for any compensation. Therefore, please keep this in mind when pre-ordering gifts to ensure they arrive close to the intended gifting date. 

Please also note that you will not be charged for the collection of your item or for the delivery of a replacement hamper. However, we are unable to reimburse the cost of returning an item to us under any circumstances as we will arrange collection through our own courier at no cost to you. 

HAMPER LISTINGS & SUBSTITUTIONS 

We at Spicers of Hythe Ltd strive to conform to our product listings, and in the event of non-availability, goods will be substituted with other items of similar quality and value. Photographic props such as glasses are not included unless otherwise stated. 

All orders are subject to availability, and if a hamper is sold out, we will endeavour to contact the purchaser to agree on an alternative hamper or to arrange a refund upon cancellation of the order. While we will do our utmost to meet the delivery date chosen, we reserve the right to miss the date if we are unable to contact the purchaser to agree on a replacement product. 

PRICES 

All prices for goods are specified on all Spicers of Hythe Ltd media (brochures or websites) and are correct at the time of publication or at agreed contract prices. VAT will be charged at the current rate on vatable items only, such as chocolates or wines, etc. We reserve the right to amend the price of a product at any time. 

DISCOUNTS 

Discount codes cannot be used on any products that are already discounted by sale prices or on products not supplied directly from the Spicers of Hythe facility in Gateshead. This includes, but is not limited to, Original Cake Co. products. 

Multiple discounts cannot be used in conjunction with each other. This includes, but is not limited to, drop shipper pricing. Codes and offers from third-party sites such as affiliates and cashback sites cannot be used with other discounts and offers on the website. Any attempts to use multiple offers will be rejected at the point of payment or within 14 days of application. 

We reserve the right to withdraw discounts prior to the stated time if required & cancel orders should they not abide by our discount policy; such decisions will be communicated on our website or by our Customer Service team. For any queries regarding discounts and offers, please contact our Customer Service team. 

WINES & SPIRITS 

All hampers that contain alcohol require the recipient to be at least 18 years of age. It is against the law to purchase or attempt to purchase alcoholic liquor under the Licensing Act 2003 if you are under 18 years of age. 

Hampers containing alcohol are dispatched with our courier on an age verification service. This service requires the delivery driver, in line with Challenge 25*, to ask the recipient to provide ID to verify their age at the point of delivery. If the recipient cannot provide ID, the goods cannot be handed over. 

If the recipient cannot provide ID, the courier will make another delivery attempt the following working day. Parcels on an age verification service cannot be left in a safe place, nor can the delivery address be changed. 

*Challenge 25 is a retailing strategy that encourages anyone who is over 18 but looks under 25 to carry acceptable ID if they wish to buy alcohol. Introduced by the Retail of Alcohol Standards Group as Challenge 21 in 2006, Challenge 25 rolled out in the off trade in 2009. 

FOOD SPECIFICATIONS & ALLERGENS 

Each of our hampers has a food specification page that you can find on the product page on our website. The information provided on these pages is accurate as of the time that our brochure went to print. However, if a substitution (temporary or permanent) is made, the nutritional and allergen summaries accompanying each hamper on our website may not be accurate.

VAT & DUTY 

As hampers are a combination of items with both 20% and 0% VAT rates, the VAT rates of the hampers may vary. The VAT rate of the hampers will be the average of the components' VAT rates, as approved by HMRC. 

SAMPLES 

Spicers of Hythe Ltd will supply samples of their hampers but reserves the right to charge for any samples at the advertised price shown in the catalogue. 

DISCOUNT CODES & CASHBACK 

Spicers of Hythe Ltd operates with a number of affiliate companies who are authorised to provide cashback and other benefits on our behalf. Our terms with these companies expressly state that payments for cashback and other benefits can not be paid if the customer uses a discount code that has not been expressly approved for use with that affiliate. All acceptable codes will be shown on the affiliate website that you are using. Use of any other code will make your cashback or discount null & void. For any queries on cashback please contact your provider as Spicers of Hythe Ltd is unable to answer queries directly for these companies.

LAW 

All hampers containing alcohol can only be ordered by customers who are over 18 years of age. These Terms and Conditions do not affect your Statutory Rights. 

These Terms and Conditions shall be governed by and construed in accordance with the laws of England. You irrevocably submit to the exclusive jurisdiction of the courts of England.
